GIVEAWAY DESCRIPTION The giveaway period begins on November 1, 2025 and ends on February 28, 2026 (the “Giveaway Period”). The sponsor of the Giveaway is Cactus Restaurants Ltd. and Cactus Restaurants USA Inc. (collectively, “Cactus Restaurants”, “Sponsor“, “we”, “us”, “our”). By participating in the Giveaway, each entrant (the “Entrant”) unconditionally accepts and agrees to comply with and abide by these Giveaway Rules and the decisions of the Sponsor, which shall be final and binding in all respects. The Sponsor is responsible for the collection, submission or processing of entries and the overall administration of the Giveaway.
ELIGIBILITY. The Giveaway is open only to legal residents of the State of Florida, USA, who are eighteen (18) years of age or older at the time of entry. Employees of the Sponsor and its affiliates, as well as immediate family members of such employees, are not eligible to participate. The Sponsor reserves the right at any time to require proof of residence, identity, and/or eligibility. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor must be truthful, complete, accurate, and not misleading.
PRIZE. One (1) winner will receive a VIP dining experience at Cactus Club Cafe, awarded in the form of a Cactus Club Cafe e-gift card valued at five hundred U.S. Dollars ($500 USD) (the “Prize”). The gift card is subject to the standard terms and conditions printed on the card and/or available at cactusclubcafe.com. The gift card may be used for food, beverages (including alcoholic beverages, where permitted by law), and other purchases at participating Cactus Club Cafe locations. The Prize must be accepted as awarded and cannot be transferred, assigned, substituted, or redeemed for cash, except where required by law. Sponsor is not responsible for lost, stolen, or damaged gift cards once issued. The winner will be contacted on or about March 15, 2026. Odds of winning depend on the number of eligible entries received. All federal, state, and local taxes on the Prize are the sole responsibility of the winner. Sponsor may issue an IRS Form 1099 to the winner as required by law.
HOW TO ENTER. No purchase is necessary. To enter the Giveaway during the Giveaway Period, an Entrant must complete and submit the official Giveaway entry form. Each Entrant is limited to one (1) entry. Each Entrant must provide all required information on the Entry Form in order to be eligible. Limit one entry per person during the Giveaway Period. Automated or robotic entries submitted by individuals or organizations will be disqualified. Internet entries must be made by the Entrant. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or other methods will void.
WINNER SELECTION. One (1) winner will be randomly selected from among all eligible entries received during the Giveaway Period.
WINNER NOTIFICATION. The winner will be notified via the email address provided. If the winner does not respond within three (3) days of notification, they will be disqualified and another eligible entrant may be selected at random.
LIMITATION OF LIABILITY. The Sponsor assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected, or incomplete entries or notifications, or for any computer, online, software, telephone, hardware, or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Entrant assumes liability for losses or costs of any kind caused or claimed to be caused by participating in the Giveaway or by the acceptance, possession, or use of the Prize. The Sponsor assumes no responsibility or liability in the event that the Giveaway cannot be conducted as planned for any reason.
CONDUCT. By participating in the Giveaway, each entrant agrees to be bound by these Giveaway Rules. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Giveaway Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Giveaway; (c) violating the terms of service, conditions of use, or general rules or guidelines of any of the Sponsor’s property or service; and/or (d) acting in a disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.
PRIVACY / USE OF PERSONAL INFORMATION. By participating in the Giveaway, each Entrant grants the Sponsor the right to collect, use, and store their personal information, including but not limited to name, email address, phone number, and preferred location (“Personal Information”), for the purpose of Giveaway administration and prize fulfillment, including contacting and announcing the winner. Entrants may also be given the option to expressly opt in to receive future marketing communications from the Sponsor, including by email and/or SMS. SMS marketing communications will only be sent to Entrants who provide separate, express consent by checking the appropriate opt-in box on the Entry Form. Standard message and data rates may apply. Entrants may withdraw consent to receive such communications at any time by following the unsubscribe instructions included in the communication. The Sponsor will use Entrant’s Personal Information only for identified purposes and will protect such information in a manner consistent with its privacy policy posted at https://cactusclubcafe.com/privacy-policy /. Personal information collected in connection with this Giveaway may be transferred to and processed in Canada, subject to Canadian privacy laws.
INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
TERMINATION. The Sponsor reserves the right, in its sole discretion, to terminate the Giveaway, in whole or in part, and/or modify, amend, or suspend the Giveaway and/or these Giveaway Rules at any time for any reason without prior notice.
LAW. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Giveaway Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Giveaway shall be governed by and construed in accordance with laws of the State of Florida and the federal laws of the United States applicable therein.
