Text Messaging Terms

1. General

The Cactus Restaurants SMS/text non-transactional messaging service (the “Service”) is operated by Cactus Restaurants Ltd. and Cactus Restaurants USA Inc. (collectively, “Cactus Restaurants”, “we”, “us”, “our”). 

We will seek your express opt-in consent to sign up for the Service. Your use of the Service constitutes your agreement to these terms and conditions, subject to applicable laws (“Mobile Terms”). By opting in to the Service, you agree to receive recurring automated marketing and international text messages from or on behalf of Cactus Restaurants through your wireless provider to the mobile number you provided. Automated messages may be sent using an automated system to the mobile telephone number you provided when signing up or any other number that you designate. You also understand that you do not have to sign up for this Service in order to make any purchases, and your consent to receive marketing text messages is not a condition of purchase. Your participation in this Service is completely voluntary.

Messages may include promotions, specials, and other marketing updates (e.g. new menu items). Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with the Service. Cactus Restaurants reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Cactus Restaurants also reserves the right to change the short code or phone number where messages are sent. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the Service with your new number. 

Cactus Restaurants will not charge you for the text messaging; however, standard message and data rates may apply to each text message sent or received as provided in your wireless rate plan. All charges are billed by and payable to your mobile service provider. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

2. Changes 

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

3. Delays

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Neither we nor any carriers are liable for delayed or undelivered messages. 

4. Age Restrictions

You must be 13 years of age or older to participate in the Service.

5. Cancellation

You can cancel any time by texting “STOP” or another accepted opt-out request keyword to the telephone number from which text messages are being sent. After you send the text message “STOP”, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive marketing and promotional text messages from Cactus Restaurants again, sign up as you did the first time and we will start sending messages to you again. If you have opted-in to other Cactus Restaurants text message programs and wish to cancel, except where applicable law permits or requires otherwise, you will need to opt out separately from those programs.

6. Info

Text “HELP” at any time and we will respond with instructions on how to unsubscribe. For additional support, contact us at guestexperience@cactusclubcafe.com.

7. Transfer of Number

You agree that before changing or deactivating your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or request that we remove your number by sending a message to guestexperience@cactusclubcafe.com. The duty to inform us based on the above events is a condition of using the Service to receive messages.

8. Privacy

Data obtained from you in connection with this Service may include your cell phone number, your carrier’s name, the date, time, and content of your messages and other information you provide to us as part of this Service. We may use this information to contact you and to provide the services you request from us. We respect your right to privacy.
